CERS to Challenge Provisions of GRUD Act
Consumer Education and Research Society (CERS), Ahmedabad has filed
an application in the High Court of Gujarat as a respondent in a Public
Interest Litigation (PIL) to challenge the validity of certain provisions
of the Gujarat Regularisation of Unauthorised Development (GRUD) Act,
2001.
The Gujarat High Court had ordered the Ahmedabad Municipal Corporation
(AMC) on 4 May 2004 to demolish 55 shops, considered to be irregular
construction, in the parking space of Vinay Arcade, near Maninagar
Railway Station.
The alleged owner of the cellar of Vinay Arcade appealed to the Supreme
Court of India against the Gujarat High Court order and contended
that it had exceeded its jurisdiction in ordering the demolition and
had proceeded in the case on the basis of some erroneously recorded
facts.
The Supreme Court sent the matter back to the High Court with the
direction to revive the matter and treat the proceedings as a public
interest litigation.The Supreme Court’s directive to treat the
case as a PIL is an opportunity for those aggrieved by the misuse
of the GRUD Act, 2001. The Act has been enacted for the regularisation
of illegal constructions, including those in the parking and sanitary
areas of commercial buildings.
